It’s an utter rout. Linux is apparently saved. SCO Thursday lost its bid to
get the jury verdict awarding Novell the Unix copyrights overturned along
with its bid to get the copyrights despite the jury decision. It also lost
its right to sue IBM for copying Unix code into Linux.
Unless it decides to appeal, one of its lawyers said, it’s all over for
SCO. And it’s not clear if SCO has the financial staying power to last
through an appeal. The legal bill for another appeal is already paid; it’s
SCO basic viability that’s in question. Of course, it doesn’t have to be
an operating company to get an appellate decision.
Deciding what to do next ultimately rests with the bankruptcy trustee, the
retired district court judge currently in charge of SCO, and he was
out-of-pocket Thursday. SCO’s general counsel Ryan Tibbets said the

Sun appears to be sticking in Oracle's craw and so it's gonna cough up more
of what it can't digest and lay off what looks to be a lot more Sun people -
mostly in Europe and Asia, it says.
It didn't say how many people but late Friday it told the SEC that the
severance charges alone would run somewhere between $550 million and $650
million.
Shortly before its acquisition closed Sun fired 3,000 people and took a $75
million-$125 million restructuring charge. You do the math.
Oracle's also projecting charges of $85 million-$115 million related to

Investigative writer Stacey Higginbotham, who is never happier than when
immersed in SEC filings, tech specs or poking through a data center, and who
has spent the last ten years covering technology and finance for publications
such as The Deal, the Austin Business Journal, The Bond Buyer and Business
Week, speculated yesterday afternoon on the GigaOm site that VMware might be
contemplating its next Cloud acquisition - to go with Zimbra and
SpringSource.
