Eliminate the legal obligation to pay many of the debts: The goal of a discharge is to reduce debts and to give a fresh start; both the chapter 7 and chapter 13 can eliminate all kind of debts.
Stop foreclosure: A home foreclosure can directly be stopped by chapter 13 bankruptcy laws, so one can be rest assured that bankruptcy can save his home.
Prevent other properties like car or other valuables from being reposed, and even though the car has been already reposed, it can be returned back by filing bankruptcy.
During times of natural accidents in the family, filing of chapter 7 can greatly reduce the amount for the medical bills. Many families have to make choices on allocation of bills. Often, bills that were once important become insignificant to the large medical bills acquired by a loved one.
Recent loss employment: A recent loss of employment is another reason where bankruptcy proves to be a boon in disguise. A family with a sudden loss of job may not be in the position to afford their medical bills. This indirectly also leads a family towards insurance protection.
Stop harassing behavior from the creditors: Bankruptcy will put a hold to the demands and stops with the harassing calls as soon as the filing is done; it now becomes the responsibility of the court to deal with the creditors.
Bankruptcy prevents the utility to be shut off. Utility can save you from staying in darkness, although the home is under the fore closer.
Bankruptcy is the only way to take care of student loan debt. Although bankruptcy does not discharge a lot of unsecured debts, but it takes care of the student loan. This is an additional advantage which bankruptcy can take care of.
The possibility of destructive nature: Nature of an individual do make a lot of difference as it makes the individual reckless and less concerned about the debts that he still owes. Divorce, gambling, reckless spending are some of the examples of self-destructive behavior.
Charges claims to fraudulent creditors: bankruptcy can challenge the creditors as well, if they proof to be fraudulent. There are attorneys to take care of the claims on behalf of the debtor.
Investing in a business without proper investigation can also lead to sudden bankruptcy as a business can suffer from heavy loss at any point of time. If we have a control on this, a lot of things could be saved. If these actions are avoided, the risk of bankruptcy is greatly lessened.
If we consider the latest statistics we will definitely find that there is a decrease in the level of people filing for bankruptcy as now the bankruptcy rules are very stringent and a lot of restriction is also applied to it. If anybody wishes to file for bankruptcy he first has to undergo a counseling session under a government approved agency.
